Cabinet simplifies granting of deferment from mobilization for people caring for sick and persons with disabilities

The Cabinet of Ministers has simplified the granting of a deferment from mobilization for people caring for the sick or persons with disabilities.

This is stated in the message of the Ministry of Social Policy, the Ukrainian News agency reports.

According to the adopted resolution, persons liable for military service who take care of a sick wife/husband, child and/or their father/mother no longer need to indicate in the Application to a territorial recruitment and social support center the information about the absence of other able-bodied family members, as well as submit documents, which confirm the impossibility of providing care by other family members.

Such information is provided only by persons liable for military service who take care of their wife's sick parents, territorial recruitment and social support centers will check it according to the data of state registers.

Also, persons liable for military service who have parents with disabilities of groups 1 or 2 no longer need to establish the fact of providing care, because, according to Ukrainian legislation, adult children who have parents with disabilities of groups 1 or 2 are obliged to support them and have the right to a deferment.

In addition, the mechanism for obtaining an act on the establishment of permanent care has been changed, the procedure and deadline for its issuance have been regulated.

In particular, from now on, in order to draw up an act of establishing the fact of permanent care, a person liable for military service no longer needs to go to a territorial recruitment and social support center, the act can be obtained by applying with an application to local self-government bodies (village, town, city, district in a city) and district state administrations.

After submitting an application, a local self-government body must consider it within 10 calendar days.

In addition, the requirement to draw up an act establishing the fact of providing care has been removed for those persons who already receive an allowance or compensation for care, for them it is enough to present the relevant documents to a territorial recruitment and social support center.

Now, the act establishing the fact of providing permanent care does not establish the absence of other family members who can provide permanent care and does not confirm the impossibility of providing such care.

As the Ukrainian News agency earlier reported, the Verkhovna Rada's Committee on National Security, Defense and Intelligence recommends that the Parliament adopt as a basis and as a whole bill No. 11391, which proposes to grant a deferment to half-brothers and half-sisters of fallen and missing soldiers.

The Verkhovna Rada wants to correct a conflict in the legislation that allows the mobilization of sick men under the age of 25.
