Health Ministry oversteps its authority by asking Charitable Foundation to transfer almost UAH 400 million for restoration of Okhmatdyt - Solodko

Yevhen Solodko, a member of the supervisory board of the Okhmatdyt Charitable Foundation, said that the Deputy Minister of Health exceeded his authority when in a letter he asked the Charitable Foundation to transfer almost UAH 400 million for the restoration of Okhmatdyt.

He said this in an interview with the Ukrainian News agency.

"No charitable organization transferred funds to the accounts of the state treasury. Moreover, the deputy minister who wrote the relevant letter, in my opinion, exceeded his authority, because the Foundation is a legal entity under private law and is definitely not under the control of the ministry. Of course, no one is going to appropriate this money, it is the people's money, therefore the responsibility of the Foundation is very great, and it is this responsibility that prompted such, at first glance, unpopular decision. But it is impossible to do it," said Solodko.

He added that the only legal mechanism that exists regarding the transfer of funds is a donation agreement with mandatory reporting on where these funds were spent.

"All the funds are in the Foundation's accounts. We proposed that when there is documentation for restoration, we will pay all expenses in accordance with the provided design and estimate documents. To date, it is not known how much the restoration will cost, who will do it, and what work will need to be done. This is first of all. And secondly, there are no legal grounds for charitable organizations to transfer funds to the account of the state treasury. Moreover, it was about this ban that the NACP reminded,” emphasized the member of the Charitable Foundation’s supervisory board.

As the Ukrainian News agency earlier reported, the Okhmatdyt Charitable Foundation did not transfer the UAH 380 million collected for hospital repairs due to the prohibition of anti-corruption agents.
