Everyone in Ukraine has right to professional legal assistance, and Volyn territorial recruitment center violates people's rights - Ombudsman

Dmytro Lubinets, the Verkhovna Rada Commissioner for Human Rights, has reacted to the lawlessness of the territorial recruitment and social support center in Volyn and emphasized the need for lawyers, because every person has the right to protection.

This is stated on the website of the Rada’s Commissioner.

Recently, the Volyn Regional Territorial Recruitment and Social Support Center reacted to the story of one of the Volyn TV channels regarding the intervention of lawyers in the processes of mobilization and medical examinations.

The territorial recruitment and social support center stated that such procedures have a specific nature and require knowledge of specialized aspects that only authorized persons and specialists possess.

They also added that the intervention of outsiders, in particular lawyers, could violate the objectivity and independence of the processes of mobilization and medical examination, which are critically important for national security.

The Office of the Commissioner for Human Rights of the Verkhovna Rada of Ukraine in the Volyn Region commented on this situation, reminding that according to Article 59 of the Constitution of Ukraine, everyone has the right to professional legal assistance. No one in Ukraine can be deprived of such a right, even under martial law.

Yuliya Spas, the representative of the Commissioner in the Volyn Region, sent a corresponding letter to the Volyn Regional territorial recruitment and social support center with the aim of clarifying and preventing violations of citizens' rights.

Ihor Kolesnikov, Deputy Chairman of the UNBA Committee on Protection of Advocates' Rights and Guarantees of Legal Practice, also commented on this situation, emphasizing that "the position of the Volyn territorial recruitment and social support center in relation to advocates does not stand up to any criticism, and may also contain signs of a crime under 397 (Interference with the activities of a defense counsel or representative of a person).”

Ombudsman Lubinets emphasized that according to Article 59 of the Constitution of Ukraine, everyone has the right to professional legal assistance.

In cases provided by law, this assistance is provided free of charge.

"Everyone is free to choose a defender of their rights, including persons liable for military service. Restriction of such a constitutional right is inadmissible in accordance with Part 2 of Article 64 of the Constitution of Ukraine," the Commissioner emphasized.

As the Ukrainian News agency earlier reported, Ukrainians complain about territorial recruitment and social support centers more than 150 times a week.
