Court orders Kyivstar to pay UAH 590,000 to state budget for illegal use of parts of hotel

The Commercial Court of the city of Kyiv has ordered the operator of the Kyivstar mobile communication operator to pay UAH 590,000 to the state budget for the illegal use of parts of the premises and the roof of the Ukraine hotel.

The Sudovo-Yurydychna Hazeta newspaper writes about this with reference to the court's decision, the Ukrainian News agency reports.

According to the case file, Kyivstar used part of the hotel premises on the technical floor (7 sq.m.) and part of the roof (3 sq.m.) to house the base station.

This premises with an area of ​​10 square meters was leased by the regional branch of the State Property Fund in 2012.

The agreement with the company was concluded for 3 years with the possibility of extension.

However, according to new legislative changes in 2020, the application for extending the lease had to be made no later than three months before the end of the contract.

However, Kyivstar submitted such a statement in violation of the deadline, as a result of which the agreement expired on August 30, 2021.

The company was supposed to return the leased property within three business days, but did so only on February 8, 2024.

In turn, the prosecutor's office filed a lawsuit in court to collect a penalty for breaching the terms of the contract.

As the Ukrainian News agency earlier reported, on September 18, the State Property Fund (SPF) identified Ola Fine LLC of the owner of the e-sports team NAVI, businessman Maksym Krippa, as the winner of the auction for the sale of the state-owned enterprise "Hotel “Ukraine".
